For all deliveries of Ibiza Fashion Factory to consumers (§ 13 BGB), these Terms and Conditions apply.
For the purpose of these General Terms and Conditions, consumer is every natural person concluding a legal transaction for a purpose attributed neither to a commercial nor a self-employed occupational activity. For the purpose of these General Terms and Conditions, entrepreneur is any natural or legal person or partnership with legal capacity acting in the performance of a commercial or self-employed occupational activity when concluding a legal transaction.

3. Conclusion of the Contract
3.1 Product descriptions in the Seller's online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Customer.
3.2 The Customer may submit the offer in writing, by fax, e-mail or by the online order form integrated into the Seller's online shop. When placing the order using the online order form, the Customer submits a legally binding offer of contract for the goods in the online shopping basket after entering its personal data and by clicking the button "place order" during the final step of the ordering process.
3.3 The Seller may accept the Customer's offer by a written (letter) or electronically transmitted (fax or e-mail) order confirmation, or by delivering the goods within five days. The Seller reserves the right to refuse the order.
3.4 Order processing and contacting usually takes place via e-mail and automated order processing. It is the Customer's responsibility to ensure that the e-mail address he/she provides for the order processing is accurate so that e-mails sent by the Seller can be received at this address. Particularly, it is the Customer's responsibility, if SPAM filters are used, to ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller with the order processing can be delivered.
4. Cancellation
General Terms and Conditions and Customer Information
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right to cancel, you must inform us (Ibiza-Fashion-Factory, Apto. De Correos 268, 07840 Santa Eulalia del Rio – Spanien, (+34) 669 575 464, info@ibiza-fashion-factory.com) of your decision to cancel this contract by a clear statement (e.g. by mail, fax or email). You may use the attached model cancellation form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and not later than fourteen days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. Please return to:

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Prices and Shipping Cost
6.1 All prices indicated by the Seller are final prices and include tax.
6.2 The shipping costs can be found regarding the respective country.
6. Delivery
7.1 Goods are generally delivered on dispatch route and to the delivery address indicated by the Customer. In the processing of the transaction, the delivery address indicated during the Seller's order processing shall be applicable.
7.2 Should the transport company return the goods back to the Seller due to the fact that delivery to the Customer has not been possible, the Customer bears the costs for the unsuccessful dispatch.
7. Payment
8.1 Payment can be made by prepayment by bank transfer or prepayment via payment service provider PayPal.
8.2 With the payment by bank transfer, we will provide our bank details in the order confirmation and deliver the goods after payment.
If prepayment has been agreed upon, payment shall be due immediately upon contract conclusion.
